Terms of Service

The agreement between you and Cliplume: how the Service works, what you own, and what we both expect.

Last updated October 17, 2026

These Terms of Service (the “Terms”) are a binding agreement between you and Cliplume (“Cliplume”, “we”, “us”, “our”). They govern your access to and use of the Cliplume website, applications and every product on them, including Video, Ad Studio (UGC and product ads), Image, Music, Recast, Extend, Insert, Auto Subtitles and Video Translation (together, the “Service”).

Please read them carefully. By creating an account, clicking to accept, or using the Service, you agree to these Terms and to our Privacy Policy, Cookie Policy and Child Safety Policy, which are part of this agreement. If you do not agree, do not use the Service.

Important. Sections 14 (Disclaimers), 15 (Limitation of liability), 16 (Indemnification) and 17 (Governing law and disputes) limit our liability and affect your legal rights. They apply to the fullest extent the law allows.

1.Eligibility and your account

Age. The Service is for people aged 18 or older, or the age of legal majority where you live if higher. It is not directed to children and we do not knowingly allow anyone under 18 to hold an account (see our Child Safety Policy). If we learn that an account belongs to someone under 18, we will close it.

Capacity and business use. You confirm that you can form a binding contract. If you use the Service for a company or other organization, you confirm you have authority to bind it, and “you” includes that organization.

Registration. You must give accurate, current information and keep it up to date. You may hold one personal account. Sign-in is provided by our authentication provider and may use your email or a third-party identity such as Google.

Security. You are responsible for everything done through your account and for keeping your credentials confidential. Tell us immediately at support@cliplume.com if you suspect unauthorized use. We are not liable for losses caused by someone using your account before you notify us, unless the law says otherwise.

Sanctions and restricted use. You may not use the Service if you are barred from receiving it under applicable law, including trade sanctions and export control rules, or if you are located in a country or region subject to comprehensive embargo.

2.The Service

Cliplume lets you create and edit video, images and music from text, images, audio and other material you provide (“Inputs”). The results we return are “Outputs”. Inputs and Outputs together are “Your Content”.

Outputs are produced by automated systems, including machine-learning models operated by us and by third-party providers. Outputs are probabilistic: they can be inaccurate, unexpected, repetitive or similar to Outputs created for other people, and the same Input can produce different results each time.

Changes. We improve the Service continuously. We may add, change, rename, suspend or remove features, models, formats, limits and prices at any time. Where a change materially reduces something you have already paid for, we will give reasonable notice or a fair remedy.

Availability. We aim for a reliable service but do not promise that it will be uninterrupted or error-free. Generation depends on third-party infrastructure and can be delayed, queued, retried or fail. Scheduled and emergency maintenance may occur.

Beta features. Features marked beta, preview or experimental are provided as-is, may change or end without notice, and may be excluded from any service commitment.

3.Plans, credits and billing

Subscriptions. Paid access is a monthly subscription (currently Spark, Pro and Max). Each paid month allocates a fixed number of credits shown on our pricing page at the time you subscribe. Prices are shown in US dollars unless stated, and may exclude taxes.

Credits. Credits are a usage balance for the Service, not money, a deposit, stored value or property. They have no cash value, cannot be sold, transferred, gifted or redeemed for cash, and are not a payment instrument. Unused monthly credits reset at renewal and do not roll over, unless a plan page says otherwise.

How usage is charged. Each generation shows an estimated credit cost before you start and may reserve (“hold”) that amount while the job runs. When a job finishes, the final charge reflects what was actually used, and any unused part of the hold is released. Costs depend on the tool, duration, resolution, quality and options you choose. Estimates can differ slightly from the final charge, and we may change credit costs going forward.

Failed jobs. If a generation fails because of an error on our side or a provider’s, or is stopped by our safety systems before delivering a usable result, the credits held for it are released or returned automatically. Outputs you simply dislike are not failures, and credits spent on them are not returned.

Automatic renewal. Subscriptions renew automatically each month at the then-current price until you cancel. By subscribing you authorize recurring charges to your chosen payment method. We will tell you in advance of any price increase, which takes effect from your next renewal after the notice.

Changing plans. Upgrades take effect immediately and are prorated for the rest of the billing cycle. Downgrades take effect at the end of the current cycle. Selecting the plan you already have is not permitted.

Cancellation. You can cancel at any time in Billing. Cancellation stops future renewals; you keep access and remaining credits until the end of the paid period. We do not provide partial-period refunds on cancellation except as set out in Section 4 or required by law.

Payment processing and taxes. Payments are handled by our third-party payment processor, which collects your payment details; we do not store full card numbers. You are responsible for applicable taxes, and the processor may add sales tax, VAT or GST where required. If a payment fails we may retry it, suspend paid features and, after a grace period, downgrade the account.

Spending limits. To protect you and us from abuse and runaway use, we apply daily and rolling 30-day spending limits and may hold or decline jobs that would exceed them.

4.Refunds

Because generation uses computing that we pay for as soon as a job runs, credits that have been spent are generally non-refundable.

We will, however, review refund requests for: (a) a duplicate or unauthorized charge; (b) a subscription charged after you cancelled before the renewal date; (c) a material fault in the Service that prevented you from using credits you paid for and that we could not fix within a reasonable time; and (d) any case where the law gives you a refund right (for example certain consumer cancellation or cooling-off rights).

To request a refund, email support@cliplume.com within 14 days of the charge with your account email and the charge details. We decide in good faith and will tell you the outcome. Approved refunds go back to the original payment method and may take several business days to appear. Nothing in this section limits rights you cannot waive under mandatory consumer law.

5.Your Content and Outputs

Your Inputs. You keep all rights you have in your Inputs. You are responsible for them, and you confirm that you own them or have every right, license, consent and permission needed to upload and use them with the Service and to grant the license below.

Your Outputs. As between you and Cliplume, and to the extent permitted by law, we assign to you whatever rights we have in the Outputs generated for you, subject to these Terms, third-party rights and the limits below. You are responsible for how you use Outputs.

No guarantee of exclusivity or copyright. Copyright law on AI-generated material is unsettled and differs by country. We do not promise that Outputs are protectable by copyright, are unique, or are free of third-party rights. Similar Outputs may be generated for others.

License to us. You grant Cliplume a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, reproduce, transmit, transcode, adapt and display Your Content solely to operate, secure, support and provide the Service to you (including sending Inputs to providers that run the models), to comply with law, and to enforce these Terms. You also grant us a limited license to display Outputs you choose to make public in any feature that lets you share them.

Training. We do not sell Your Content, and we do not use your private Inputs or Outputs to train generative models that we make available to others without your permission. Aggregated, de-identified usage statistics may be used to improve reliability, pricing and safety.

Retention. Creations in your library are kept while your account is active, may be deleted automatically after a period of inactivity (currently 14 days without activity on a creation), and are deleted when you delete them. Download what you want to keep. We are not a backup or archive service and are not liable for the loss of Your Content.

Feedback. If you send us ideas or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.

6.Acceptable use

You agree to use the Service lawfully and responsibly. You must not, and must not help anyone to:

  • create, upload or share any content that sexualizes, exploits or endangers minors, in any form, real or fictional. We have zero tolerance and report apparent child sexual abuse material to the authorities;
  • generate sexually explicit content, pornography or nudity, or depict a real person in a sexual or intimate way;
  • create realistic depictions of a real person, including their face, voice or body, without that person’s clear, informed consent, or impersonate any person, brand or organization to mislead;
  • produce deepfakes or synthetic media intended to deceive, defraud, harass, defame, intimidate or manipulate elections, public opinion or financial markets;
  • promote or depict real violence, terrorism, extremism, self-harm or suicide, human trafficking, or hate against people because of race, ethnicity, religion, gender, sexual orientation, disability, age or any protected characteristic;
  • create content that is illegal or fraudulent, or that promotes illegal goods, weapons or controlled substances, including fake reviews, scams and phishing;
  • infringe or misappropriate anyone’s intellectual property, privacy, publicity or other rights, including uploading material you do not have rights to;
  • upload malware, or probe, scan, disrupt, overload or attempt to gain unauthorized access to the Service, its accounts, networks or providers;
  • circumvent safety systems, rate limits, spending limits, credit accounting or usage restrictions, or craft inputs designed to defeat content filters;
  • scrape, crawl or bulk-download the Service, or use Outputs to build a competing product or to train a model that competes with the Service;
  • resell, sublicense or provide the Service to third parties as a service bureau without our written agreement;
  • reverse engineer, decompile or extract source code, model weights or prompts, except where the law forbids this restriction;
  • create multiple accounts to abuse offers or evade a suspension or ban; or
  • use the Service in a way that violates applicable law, or that could harm Cliplume, its users, providers or the public.

AI disclosure. Where the law or a platform’s rules require you to label AI-generated or synthetic content, you are responsible for doing so. Do not remove provenance or watermark information where we apply it.

Safety systems. To keep the Service safe, requests and Outputs are checked by automated systems and, where necessary, reviewed by people. We may refuse, block, edit or remove any request or Output, and some safe requests may be refused by mistake. Repeated or serious violations may lead to suspension, termination, loss of credits without refund, and referral to law enforcement.

7.People, likeness and consent

Features that use a photo, video or voice of a real person (such as Recast, character photos in UGC ads, and translation of speech) require that the person depicted has given clear, informed consent to that specific use. When you submit such an Input, you confirm that you have that consent, in writing where the law requires it, and that your use will not violate their rights.

You must never use another person’s likeness to suggest they said, did or endorsed something they did not. You are solely responsible for claims, takedown demands and damages arising from your use of a person’s likeness. We may ask you for evidence of consent and may remove content or suspend features if you cannot provide it.

8.Third-party services and content

The Service relies on third-party providers for authentication, payments, storage, delivery, analytics and the AI models that produce Outputs. Their availability and terms can affect the Service, and we are not responsible for their acts or failures. By using the Service you acknowledge that your Inputs are sent to those providers as needed to fulfil your request, as described in our Privacy Policy.

The Service may link to third-party sites. We do not control or endorse them and are not responsible for them. Your use of them is at your own risk and subject to their terms.

9.Our intellectual property

The Service, including its software, design, interface, text, graphics, logos, trademarks (including “Cliplume”), documentation and underlying technology, is owned by Cliplume or its licensors and protected by intellectual property laws. Except for the rights expressly granted in these Terms, we reserve all rights. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your own lawful purposes in line with these Terms.

11.Suspension and termination

By you. You may stop using the Service and close your account at any time in Settings or by contacting support@cliplume.com. Closing your account does not by itself refund fees already paid.

By us. We may suspend or terminate your access, remove content or restrict features immediately, with or without notice, if you breach these Terms, create risk or legal exposure for us or others, fail to pay, or if required by law or a provider. Where practical and lawful, we will tell you why and, for non-serious cases, give you a chance to fix the issue. We may also discontinue the Service or any part of it, in which case we will give reasonable notice and a fair remedy for prepaid, unused periods.

Effect. On termination your right to use the Service ends, any balance of credits is forfeited (except where a refund is due under Section 4 or the law), and we may delete Your Content after a reasonable period. Sections that by their nature should survive (including ownership, payment obligations, disclaimers, limitation of liability, indemnification and dispute resolution) will survive.

12.Privacy and data protection

Our Privacy Policy explains what personal data we collect, how we use and protect it, who we share it with, and the rights you have. If you upload personal data of other people, you are responsible for having a lawful basis and for the notices and consents the law requires.

13.Changes to these Terms

We may update these Terms, for example to reflect new features or legal requirements. If a change is material, we will give you notice by email, in the product or on this page, normally at least 14 days before it takes effect, unless the change is required sooner by law or to address a security or safety risk. The “Last updated” date shows the latest version. If you keep using the Service after the effective date, you accept the updated Terms. If you do not agree, stop using the Service and cancel your plan before the change takes effect.

14.Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE; THAT OUTPUTS WILL BE ACCURATE, ORIGINAL, LAWFUL TO USE IN YOUR INTENDED WAY, OR FREE OF THIRD-PARTY RIGHTS; OR THAT ANY DEFECT WILL BE CORRECTED. OUTPUTS ARE NOT PROFESSIONAL, LEGAL, MEDICAL OR FINANCIAL ADVICE. YOU ARE RESPONSIBLE FOR REVIEWING OUTPUTS, AND FOR OBTAINING ANY CLEARANCES, BEFORE PUBLISHING OR RELYING ON THEM, INCLUDING IN ADVERTISING.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you. Consumer rights that cannot be excluded remain.

15.Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLIPLUME, ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO CLIPLUME IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US$50.

These limits do not exclude or limit liability that cannot be excluded or limited by law, such as liability for fraud, death or personal injury caused by negligence, or willful misconduct. They apply even if a remedy fails of its essential purpose, and they reflect the allocation of risk that lets us offer the Service at its price.

16.Indemnification

You will defend, indemnify and hold harmless Cliplume and its affiliates, officers, employees, contractors and providers from and against any claims, damages, liabilities, losses, costs and expenses (including reasonable legal fees) arising from or related to: (a) Your Content, including any claim that it infringes or violates a right or a law; (b) your use of an Output, including in advertising or commerce; (c) your breach of these Terms or applicable law; or (d) your use of another person’s likeness without consent. We may assume the exclusive defense of any matter, and you will cooperate with us. You may not settle a claim that imposes obligations on us without our written consent.

17.Governing law and disputes

Informal resolution first. Before starting any formal proceeding, you agree to contact us at support@cliplume.com and give us at least 30 days to try to resolve the dispute in good faith.

Governing law and courts. These Terms and any dispute arising out of them are governed by the laws of the jurisdiction in which Cliplume is established, without regard to its conflict-of-law rules. Subject to the next paragraph, the courts of that jurisdiction have exclusive jurisdiction, and each party submits to them.

Consumers. If you are a consumer, nothing in these Terms removes mandatory consumer protections of the country where you live or your right to bring a claim in its courts where the law gives you that right.

Class actions. To the extent permitted by law, you and Cliplume each agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective or representative action.

Limitation period. To the extent permitted by law, any claim relating to the Service must be brought within one (1) year after it arose.

18.General

Entire agreement. These Terms, with the policies they reference and any plan terms shown at purchase, are the entire agreement between you and us about the Service and replace earlier agreements on it.

Severability and waiver. If a provision is found unenforceable, it will be limited to the minimum extent needed and the rest remains in force. A failure to enforce a right is not a waiver of it.

Assignment. You may not assign or transfer these Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization or sale of assets, or by operation of law.

Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including outages of internet, cloud or provider services, natural disasters, war, labor disputes, or acts of government.

Notices. We may notify you by email to your account address, through the Service, or by posting on this site. You may notify us at support@cliplume.com. Notices are effective when sent.

Interpretation. Headings are for convenience. “Including” means “including without limitation”. If we provide a translation, the English version controls where the law allows.

Relationship. You and Cliplume are independent contractors. These Terms do not create a partnership, agency, employment or joint venture, and give no rights to anyone who is not a party, other than the people and providers named in Sections 15 and 16.
